PwC Webcast – India’s New Indirect Tax Levy on B2B and B2C Digital Supplies

webcast-indiaAs part of the changes to India’s tax landscape and in alignment with BEPS Action Paper on the Digital economy (eCommerce, internet businesses, etc), the Government of India has made certain key amendments to the Indirect tax law as applicable to B2B and B2C Online as well as eCommerce companies. Cumulatively, the amendments seek to levy Service Tax on digital supplies into India effective from 1 December, 2016. These digital supplies include services such as online gaming, advertising on the internet, providing cloud services, digital data storage, providing access to e-books, movies, music, software etc. This potentially has a very wide impact across various service providers in these online segments and has a direct bearing on online companies providing services from outside India to consumers directly in India.

The companies would need to address requirements like mapping the transactions liable to service tax, evaluating the revised tax positions, compliance requirements such as registration, return filing, invoicing, etc. Given the short time span within which the changes are required to be made, the same could pose considerable challenges to the service providers. Further, the timing of this change has also created additional hardship, given that companies may need to prepare for another change when GST is introduced in April 2017.
